The Safe+Driver Application is developed and designed by Copernicus, LLC (“Safe+Driver”,“we”,”our”,”us”) and is committed to protecting your privacy.

This Privacy Policy (the “Policy“) applies to the Safe+Driver Application (the “App“) and our website (the App and the website together, the “Service”). By using the Service, you consent to the data practices described in this Policy. Collection of your Personal Information or Personally Identifiable Information is data that can be used to identify or contact a single person. 

How We Collect Personal Information

Registration and Profile Information.  When you download the App, you may provide Safe+Driver with personally identifiable information that may include, but not be limited to, your e-mail address, name, and telephone number.  If you elect to give a family member access to your account, we will collect the family member’s name, email address and phone number. 

Geolocation Information.  The App collects your location information through your GPS coordinates available through your mobile device.  We collect and maintain the location data (driving data from your phone such as driving speed, time of day and GPS-based location data) as a core function of the App.

Specific Driving Information.  We collect sensory and motion data from your mobile device including information from the gyroscope, accelerometer, compass and Bluetooth in order to calculate and note driving actions and events.

We will retain your personally identifiable information for the period necessary to fulfill the purposes outlined in this Policy unless otherwise required or permitted by law.

The App is intended to collect your driving information but may inadvertently collect the driving information of third parties with whom you are a passenger. No records will be created that identify any such third parties.

Use of your Personal Information


Safe+Driver uses your personal information to improve our services to you by improving the Service’s performance. Except as set forth in this Policy, we will not use, disclose, or transfer your personally identifiable information or the personally identifiable information of others you have provided us unless:

1.    You expressly authorize us to do so.

2.    It is necessary to allow our service providers or agents to provide services for us.

3.    It is necessary in order to provide our products or services to you (and contacting you when necessary).

4.    We are sending you other information that may be useful to you.

5.    It is necessary to protect the confidentiality or security of your records, subject to applicable contractual or legal restrictions.

6.    It is necessary in connection with a sale of all or substantially all of the assets of Safe+Driver or the merger of Safe+Driver into another entity or any consolidation, share exchange, combination, reorganization, or like transaction in which Safe+Driver is not the survivor.

7.    It is necessary in connection with other business purposes including, without limitation, customer care, service quality, business management and operation, risk assessment, security, fraud and crime prevention/detection, monitoring, research and analysis, marketing, customer purchasing preferences and trends and dispute resolution.

8.    It is necessary to comply with law enforcement, governmental mandate, or other legal requirement, if appropriate, for your protection or in connection with an investigation or prosecution of possible unlawful activity.

9.    It is necessary for us to provide it to our attorneys, accountants, regulators, auditors or other advisors.

10. It is otherwise necessary for us to disclose it as required or permitted by law.

 From time to time, we may use your personal information to send important notices, such as communications about changes to our terms, conditions, and policies. Because this information is important to your interaction with Safe+Driver, you may not opt out of receiving these communications while you continue to utilize the Service. We may also use personal information for internal purposes such as auditing, data analysis, and research to improve Safe+Driver’s products, services, and customer communications.

Disclosure of Personally Identifiable Information to Third Parties

Safe+Driver may share personally identifiable information with trusted partners to help us perform statistical analysis. All such third parties are contractually prohibited from using personally identifiable information provided by the App except to provide these services to the App, and they are required to maintain the confidentiality of your information with equal or greater protections than those provided by the App.

Safe+Driver will disclose your personally identifiable information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Safe+Driver; (b) protect and defend the rights or property of Safe+Driver, (c) act under urgent circumstances to protect the personal safety of users of Safe+Driver or the public, or (d) to enforce our Terms of Use, take precautions against liability, to investigate and defend ourselves against any claims or allegations, or to protect the security or integrity of our Services. 

In the event we sell or divest the Company, or enter into a transaction to combine our assets, products services or business with another company, personal information including but not limited to customer names and email addresses may be one of the items transferred in such a transaction.  This type of personal information may also be shared, transferred or assigned in the course of mergers, acquisitions, bankruptcy or dissolution proceedings.  Safe+Driver may also disclose personal information about you if Safe+Driver determines that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate.

Security of your Personally Identifiable Information


The Service secures your personally identifiable information, and the personally identifiable information of others on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. However, no data transmission via cellular or Internet can be guaranteed as 100% secure. As a result, while we strive to protect your information, we cannot ensure or warrant the security of any information you transmit to us or receive from us.

Access to Personal Information


For the personal information we hold, we will provide you with access for any purpose including to request that we correct the data if it is inaccurate or delete the data if Safe+Driver is not required to retain it by law or for legitimate business purposes. We may decline to process requests that are frivolous, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law. Collection and Use of Non-Personal Information


We also collect data in a form that does not, on its own, permit direct association with any specific individual. We may collect, use, transfer, and disclose non-personal information for any purpose. The following are some examples of non-personal information that we collect and how we may use it:

  • We may collect information regarding customer activities on the Service. This information is aggregated and used to help us provide more useful information to our customers and to understand which parts of our products and services are of most interest. Aggregated data is considered non-personal information for the purposes of this Privacy Policy.

  • We may collect details of how you use the Service. This information may be used to improve the relevancy of results provided by the Service.

  • We may collect analytics data to help us measure traffic and usage trends for the Service.

If we do combine non-personal information with personal information the combined information will be treated as personal information for as long as it remains combined.

Information Collected from Children


We are committed to taking extra precautions to protect the privacy and safety of children. Accordingly, we do not knowingly collect, use or disclose personal information from children under 15 without verifiable parental consent. If we learn that we have collected the personal information of a child under 15 without first receiving verifiable parental consent, we will take the steps necessary to delete the information as soon as possible.

Changes to this Policy


We may change this Policy at any time and from time to time. The most recent version of the Policy is reflected by the version date located at the bottom of this Policy. If we make any material changes to our Policy, those changes will apply to the personally identifiable information collected after the effective date listed on the Policy, and we will notify you by placing a notice on the App‘s download page prior to the change becoming effective. We encourage all users to periodically review this Policy for the latest information on our privacy practices.

Removal of Your Personal Information

We retain your information for as long as your account is active or as reasonably necessary to maintain our Service, meet legal and accounting obligations, and for other reasons set forth in this Privacy Policy, as may be updated or amended.  If you wish to delete your personal information from our records, please contact us at moreinfo@mysafedriver.org.  When information is deleted, certain residual information may remain in our archives for support purposes or in backup records for some period of time pursuant to our data retention policies.

California Privacy Rights

As a California resident, you may be able to exercise the following rights in relation to the Personal Information about you that we have collected (subject to certain limitations at law):

  • The Right to Know.  You have the right to request any or all of the following information relating to the personal information we have collected about you or disclosed in the last 12 months

  • The Right to Request Deletion.  You have the right to request the deletion of personal information that we have collected from you, subject to certain exceptions.

  • You have the right not to receive discriminatory treatment for exercising any of the rights described above. However, please note that if the exercise of the rights described above limits our ability to process personal information (such as in the case of a deletion request), we may no longer be able to provide you our products or services or engage with you in the same manner.
